Rule 2. HOURS AND TERMS OF COURT
All sessions of Court shall begin at 9:00 A.M. and attorneys and witnesses should be present at that time. For jury trials, counsel and the parties shall be present at 8:30 a.m. The following minimum hours are established for the Clerk's office of each division, except the Municipal Division, to be open to the public: 8:30 A.M. to Noon, and 1:00 P.M. to 4:30 P.M. The Clerk's office shall be open to the public those hours, five (5) days a week, Monday through Friday, for the purpose of the regular filing of documents in that office; excepting legal holidays. The Clerk's office is deemed always open for the filing of documents. This rule shall not effect the hours an employee is to work under that employee's budgeted FTE position. The Court will observe the following holidays: Those holidays observed by State Offices of the State of Missouri; or, as ordered by the Chief Justice of the Supreme Court.
(1) Regular Terms of Court
The Circuit Court of each county of the Twenty-seventh Circuit shall be in continual session as provided by Section 478.205, RSMo. To the extent that a term of Circuit Court may be required or specified by these rules or by any provisions of law, the "terms" of Court for all divisions shall be considered as commencing on the dates as hereinafter stated:
(a) In Bates County on the third Monday in the months of January, May and October.
(b) In Henry County on the second Monday in the months of January, April and September.
(c) In St. Clair County on the first Monday in the months of March, June and November.
(d) If the first day of a term should fall on a holiday, the term docket call shall be the day following.
2.3 LAW DAYS
The law day for the Circuit Division will be held as specified by the Court at the commencement of each term of Court. The remaining divisions of the Circuit Court need not have regularly scheduled law days.
2.4 PARTICULAR MATTERS ON PARTICULAR DAYS
(1) Matters Heard on Law Days
(a) Routine Matters
Motions requiring notice and hearing, matters which do not require more than fifteen (15) minutes of testimony for disposition, domestic relations cases in default or where all issues have been resolved by the parties, matters in default, and other proceedings set specially by the Court may be heard and disposed of on regular Law Days.
Any matter to be so heard shall be on such notice as required by Missouri Supreme Court Rules or applicable statute, and at such time as appointed by the Circuit Clerk. All matters to be heard on Law Days shall be heard in the order docketed by the Circuit Clerk, and any matter not ready for hearing when called shall be recalled at the end of the Court's other scheduled business for the day, if time permits.
(b) Matters Requiring Testimony
No matter requiring testimony longer in duration than fifteen (15) minutes shall be heard on Law Days unless specifically set by the Court, and such settings shall be at the conclusion of other scheduled business unless otherwise ordered by the Court, and the Court may continue the same to another date if time requires.
(2) Juvenile Matters
(a) Adoptions
Adoptions shall be heard on Juvenile Days unless otherwise ordered by the Court. If an adoption is heard on a Law Day, the Circuit Clerk shall not list the case caption on any printed docket, but only the case number.
If an adoption is contested the same shall be set for hearing as other civil cases are set for trial.
(b) Juvenile Days/Other Matters Heard
No matter other than juvenile matters shall be heard on Juvenile Days without prior Court approval.
(c) Designation of Juvenile Days
The Court shall designate Juvenile Days at the commencement of each Term of Court.
(3) Trial Days/Hearing Of Other Matters
No motions or hearings, except those relating to the case or cases to be tried, shall be heard on trial days without prior Court approval.
